Senior woman expelled from Germany after dangerous oxygen abuse!

In a shocking legal case that stirs emotions, a 75-year-old senior woman in Mannheim was sentenced to three years in prison for attempted murder. This decision was made in 2023 after the woman turned off her 79-year-old fellow patient's oxygen machine in the hospital in November 2022 in order to sleep better. Tragically, this action led to the victim suffering from severe breathing problems, who died shortly afterwards of multi-organ failure. A judgment that was carefully documented by PZ-News.

The Mannheim regional court found that there was a conditional intent to kill, which highlighted the defendant's criminal energy and lack of awareness of injustice. It was highlighted that despite the two and a half years in prison, there were no positive developments regarding the woman. The chamber also expressed concerns that she could commit further crimes against life and limb.

Karlsruhe Administrative Court decided on the expulsion

The Karlsruhe Administrative Court took the matter into its own hands and decided that the senior citizen will probably have to leave Germany because she represents a “serious threat to public safety.” The Turkish woman's application against her expulsion was rejected, although the judgment is not yet final (ref. 1 K 5335/24). This is a complex case that raises not only legal, but also moral and social questions.

Attempted homicide in German jurisprudence

Attempted homicide is a serious crime for which, according to Section 23 Paragraph 1 of the Criminal Code, a prison sentence without parole cannot generally be imposed for less than five years. Homicide is defined as a crime in German law, and the absence of justification or excuse is a prerequisite for criminal liability. In serious cases, the sentence can even be life long. According to Juraforum, the criminal law framework is clear, but the question remains as to how society deals with such misconduct.

Homicide statistics in Germany

A look at the police statistics from the last few years shows that cases of homicide are a serious issue in Germany. From 2014 to 2024, the Federal Criminal Police Office published significant figures that show a growing problem. These developments should make us think. Further information about the cases recorded by the police is available at Statista.

The matter raises many questions: What are the limits of responsibility? How can we ensure that every person is protected from harm by others? The answers are probably as diverse as the people themselves, and one can only hope that fair decisions are made to prevent such tragedies in the future.
